Hi,

Looking for some advice. I had hoped that we were going to reach a settlement before having to go to the first hearing but ex has left it to the last minute to change the goal posts and i now think i have to go to court.

The problem is that i had thought we would settle so I have not prepared my form E and it's due in in 2 days. I can probably get it done but if not can i get away with submitting it to the court late?

Deadlines in family law are a bit fluid so in reality a few days late isn't going to make a lot of difference.

If he is represented, you should write to his solicitor to rearrange the date of exchange and make it clear why things are delayed.

Remember once you have exchanged form E there will be further paperwork to complete before the first hearing. This too may have to be delayed slightly.
