What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hi,

I had an original CAO which stated me and ex shared the summer hols, 3 weeks each to be arranged by ourselves. Unfortunately my ex was refusing to sort them out in reasonable time so I went back to court earlier this year to get the order varied.

The new order now states that I have week 1, 4 & 5 and ex has weeks 2, 3 & 5.

Now, I've just seen school calender for 2020 and our sons school breaks up on a Friday, its usually on a Tuesday and there are 7 weeks instead of 6.

So I'm going to email ex to propose that we both have 2 1/2 days each of the 7th week but I'm quite confident that she'll refuse my offer.

If I have to go back to court to sort that week out for next year, and any future years it happens, is it a Specific Issue application or another variation order, even though we've just been through one?

Thanks

It would seem a shame to have to go back to court for that. Why dont you ask her what she would like to do that would be reasonable and give her a time period to get back to you on it.

It would seem it would either be half the week each or you do turn about each year where there is an odd week. You could check the calendar the following year too if available and then suggest something that might be equal?

Hi,

I'm going to suggest that I have the first half of that week as our son is with me the weekend it starts and she has the second half then it's her weekend before school starts.

To show I'm being reasonable if I have to take it back to court I will also state that she can have the first half if she wants.
