What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

I self represented at the FDR, and I’ve been sent a court order for Final Hearing which was written by Wife’s barrister. At the FDR the judge said the order had to be agreed between us then sent to her, but I never saw it.

I have 2 issues, is there anything I can do? E.g contact the court?

1. At the FDR she gave very dodgy evidence of Mortgage Raising Capacity (basically just got an expert to sign off a figure that suited her). There is nothing to stop her doing this again. On good advice I handed the judge and barrister a document at the FDR which expressed my wish for her to be Ordered to get a capacity report from one of 3 suggested advisors I, or I can submit my own evidence of her mortgage capacity. This has been ignored.

2. I only received the Order yesterday, and a deadline for an important decision is on Tuesday. Would it be ok to be a few days late, while I gather some advice on the matter?

I’m most concerned about the lack of inclusion to point one even though I specifically requested it. Is there any way to get it added?

I've now gained some good advice so point 2 has been sorted.

With further research on point one,

I can either do a Part 25 application for the provision of expert reports or I can simply file my own report insist it's included in the bundle or failing include in my own supplementary bundle

Thoughts on this?
