What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

The first thing you need to do is make sure you are fully familiar with the process so you can understand what needs to be produced and when.

You should have a notice of first appointment that tells you when and where the hearing will be. It should also give dates when various documents need to be lodged with the court (filed) and sent to the other side (served).

The first is form E. You can find guidance in the library on this site, and we also provide low cost support to litigants in person - this includes checking Form E.

You will need to collect documents for the Form including 12 months statements for each account, 3xrecent payslips, p60, valuations etc.

You will need to contact the other side the arrange the exchange of Forms E. Even if they aren't ready on time, it is important to file at the court on or before the deadline.

Once you have exchanged Forms E, you need to produce other documents for the court. The questionnaire, chronology and statement of issues should all help the judge to understand the matter and ensure the fullest possible financial disclosure. Again this is something we can help with.

You also need to complete Form G to say whether or not the hearing can be FDR - this is usually the second hearing at which offers are discussed and settlement can be agreed.

And finally Form H which is a statement of costs incurred. As litigant in person you can put your time down at £19/hr.

Do give the helpline a call if you get stuck with anything.
