What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

What forms do we need?

Hi, my ex has agreed a settlement on pension's split, property and debts. We already have a Decree Nisi.
I know I need a Consent Order to be drafted to put to the court but are there other forms required like a "pension annexe" I've seen mentioned?
Confused..
Thanks, Ship

A consent order really needs to be properly drafted by a lawyer. If pensions are to be shared a pension sharing annex will be drawn up alongside the consent order. You will need to complete a D81 Statement of Financial information to go with the order. This will help the judge to see that the agreement is fair.
A form A application will also need to be submitted.

You may want to look at the Consent Order drafting and submission service offered by this site.
