What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

I have been in the court process since 2018. I have had over 10 hearings and struggled. I have been awaiting along time for a mental health assessment with a psychiatrist.

I had it in Oct having waited over 4 years. I have had my report back with a diagnosis of Autism and ADHD (inattentive). This will explain why have been struggling with the court nuances.

How to I go about telling the Court about my diagnosis? Is there a form?

Both parties are LIP.

Thank You

A lot of neuro typical people struggle with the court process so it's no surprise your neurodivergent brain is finding things difficult.
Unfortunately though I doubt the court would have a great deal of sympathy for delays caused e.g. by failure to follow court directions.

You can simply send evidence of your diagnosis to the court and the other side. It may be that the organisations supporting people with similar brains have advice that could be useful. I imagine employment might be an issue and this diagnosis may explain any problems you have with working and earning.

Assuming you cannot find/afford a solicitor to represent you, you may need to see if you can find someone to support you through the process, checking in on deadlines, making notes in court etc.

This site has lots of helpful information for LIPs and you can always ask questions on the forum or maybe have a chat with one of our consultants if there's something in particular you need help with.
