What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

I wrote a statement about domestic abuse for a non molestation order. I have also applied for an occupation order. He received these and we attended court for an initial hearing last week. He has since sent copies of my witness statement to all of his family and friends. Basically as he says it is all lies. The content of it includes sexual information and covers all areas. He also spent two hours talking to my mum last weekend when I was away. He convinced her it was all lies and that she should encourage me to drop it all and it will cost me a fortune and I will lose. She then sent me texts to say I had to drop it all and that she would speak to me late sunday evening when I returned home to go back to the original idea of giving him money to leave the house. She did convince me it was sensible as I am autistic and terrified of the whole process and upheaval. I have never been able to stand up for myself with him. Yesterday evening she saw me again as she spoke to my sister who said I was doing the right thing to be going through the solicior and get that support and to not trust him to come back for more if I gave him money. I am trying to decide if this is a breach of the non molestation order. My mum is very easily manipulated and wants the easy way in things. I am quite the same. It makes us very timid and fearful. He also sent her some text messages. Telling her to look at my witness statement whilst staring me in the eyes so that as a mum she would know the truth. Unfortunately she did text him back saying she spoke to my sister and would get me to drop it.

Are you getting help from any of the organisations that support survivors of domestic abuse? If you are not then it is worth making contact so they can support you with this. It may also be worth having a chat with the police on the non emergency number.
Hopefully you can get an occupation order so you have space to deal with the divorce and financial proceedings without this pressure.
