What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

We are only a few weeks from the first appointment.

The applicants lawyer made various excuses last week for not sending the form E by the deadline. First they claimed a lack of staff, then that they would send it once theyreceived mine (they said they had not yet got it - by post). They said they had filed it with the court. The lawyer has now gone on holiday for a week (I got an auto-reply to an email stating that).

It looks very much that they are deliberately delaying. I suspect my ex may decide to withdraw the case without disclosing her financial position. Can the applicant do that? Now that the process has started I would like to finish it.

I have emailed the court for and asked a copy and got a form reply back about how to submit my documents. I phoned and was told to email, so emailed again asking for a copy. No reply as yet.

Should I complain to the court I have not got the Form E or leave it until the first appointment? Is there a way I should complain about this? If so, how - is there a particular court form I should use?

I read a post here suggesting leaving it until the first appointment. The problem is that I think it likely her form E will be misleading or omit information and want time to be able to question it.

They have now emailed me saying they have not received my Form E and "We cannot send our client’s Form E to you until we have received yours".

They also say its not been uploaded to the case by the bulk scanning centre.

Just to say it got sorted out after a fairly acrimonious exchange of emails.
