My partner filed for divorce and no acknowledgment was received back from the respondent. He used the court bailiff services and the court have just advise me that bailiffs were unable to serve the papers. The respondent does live at the address used.

I have called the court to ask if my partner can now use option C as stated on D9H 'apply to the court ex-parte on affidavit for the DJ to consider whether the directions should be given' but they cannot comment.

Is this the next route (option C) to take with DIY divorce? They have now been separated for 6 years.

Hi Buster,

As more than 5 years have passed I believe you can apply for divorce without respondents consent. If there are no finaces outstanding, there shouldnt be a problem.

There are no finances, property or children. Does he use option C given on the D9H form? What form(s) are required?
