What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Me and my x have agreed a child maintanence figure, but dont really want to incur solicitor costs.

Is it possible to take this to a court and get it agreed yourself.

Also any idea on hom much the court fees would be ?

Thanks

At what stage are you? If you have yet to reach a financial settlement child maintenance can be included in a Consent Order.

Well in terms of finances we have agreed settlement a figure on the house. We have agreed a CM figure based on the online CSA calculator.

The main reason for getting this court approved is to satisfy the mortgage company that she can consider this as income and use that in her mortgage application. The mortgage company won't accept the CM payments if its not court approved.

If you can reach an agreement between yourselves so that no future claims can be made against each other you will need a solicitor to draft it into a Consent Order. This can include child maintenance and one signed off by a judge is legally binding.

It is possible to agree child maintenance separately, but that would mean another order and the associated expenses.

It depends upon the complexities but a high street solicitor might charge £800 whereas you can get online Consent Orders for less than £100. You don't get the same service but if the finances are straight forward perhaps you don't need it.

Thanks for your help.

I think we could get away with the online route as the fins are very straight forward.
