Hi I would really appreciate some advice. I am the Petitioner in divorce. At Decree Nisi stage. I have been receiving legal aid. I received a letter from my solicitor saying the court has ordered my husband to pay divorce costs (such costs to be assessed if not agreed) what does that mean? Does it mean I am not receiving legal aid anymore (because he has to pay)?, how much will this be and how will he pay if he does not have the money to do so? Does assessed if not agreed mean if he objects I could be made to pay half myself? Thanks

Firstly legal aid is not my thing but the cost to be assessed etc means that the court will assess a figure of costs if the parties don''t agree one.

How much the costs will be is anyone''s guess really. The costs will be reflected in his finances as a liability although it starts to get a bit complicated as in reflecting that liability the costs have to be known.

Quite frankly Clare the costs are the least of you worries because if you get any the legal aid fund may nab them first. Concentrate on getting divorced with a decent split of the financial pot.
