hi all agreed to ask this of the good ppl on wiki for a friend of mine at work with no computer access. Hope someone can help

Basically he was respondent and his ex''s solicitor agreed in open correspendence to his solicitor to limit their divorce costs to £400 for an ub order. Absolute went through many months ago but he never remembers paying this fee or being asked to ! File long since closed by his sol. Ancillary was done seperately through Clean Break consent.

Should he do anything?

Personally - if it were me - I would.

I wouldn''t want it hanging over my head and thinking every envelope coming through the door could be a ''request'' for the money.

I would make a call to the Sols and explain and take their advice.

Did he make any payments up front? Some solicitors request an initial lump of funds when they take on the case initially - it may have been taken out of that?

They may have forgotten about it which is common as the divorce is usually sorted before the finances and it gets left behind, or the Petitioner gives instructions not to rock the boat.

Alternatively, did your friend receive a cash settlement from the finances? If so, the fee may have been taken from that sum which should be documented on a settlement statement somewhere.

Ok thanks guys i''ll ask him tomorrow but the impression I got was it''s simply been forgotten. Was it the Petitioners responsibility to request payment or his to pay?!

I''m sure there is a board game with questions along these lines!

Update- he didnt receive a settlement he paid one so no adjustment there! He seems to think solicitors were responsible for ensuring everything was squared away and its their responsibility. i dont know.

What is the worse that could happen? They ask for the £400 at some point in the future?

How long ago are we talking? If it was a couple of weeks ago he may still receive a request for payment but as more time elapses, the less likely it is that he will be asked to pay.

Your friend could offer to pay up now or wait until he is asked to pay - it is up to him.
