I think it depends on the grounds and whether or not she has checked a box on the forms to ask for costs. Is she eligible for legal aid? If she is i dont think they go after the respondent for the costs.

I''m not sure if she''s eligible for legal aid as she refuses to divulge how she is paying for her legal fees.

The grounds of the case are adultery on my part.

Well if you have admitted the grounds she is more than eligible to request you pay her costs. I believe there is a part of the form where she can express her desire to do so.

I thought there was a ''no blame'' view on divorce? It doesn''t quite seem right that I''m being punished financially for something that happened after we were seperated and living apart?

I''m not overly clued up on the law but from what i understand if you are using grounds other than 2 year separation then there will be a degree of blame, and by ''confessing'' to the accusations made you are admitting you are to blame and being liable for the costs is one of the consequences.

Have you already admitted adultery? I think i read on another post that you have been separated for around 4 years or so? Can you not ''counter offer'' a divorce on the grounds of 2 yeas separation? Depending on whether the papers have been filled in yet.

unfortunately papers have been filed and a Decree Nisi has been granted on the grounds of adultery. i guess i''m best to try and settle out of court?
