What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hi,

I would be grateful if anyone could advise if the court fee of £410 needs to be sent in the form of one cheque or can it be sent £205 each in the form of two cheques from both applicants.

Thank you for any assistance.

You can only have one Petitioner to a divorce.

It would be ''cleaner'' to send one cheque but there shouldn''t be a reason not to accept two cheques - this is often done when parties submit a consent application.

However, if one of the cheques is from the respondent to the Petition, a court clerk may send the Petition back on the grounds that the respondent cannot fund an application against themselves. May happen - may not.
