What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

My partner is trying to negotiate financial settlement with his ex, who wants to take the house, his pension, 75% of his salary and my earnings and house.

We have worked out that she can't afford to buy him out of the marital home, although she currently refuses to move.

I have just found out that I am pregnant - is this going to affect their financial settlement? Should we tell his solicitor?

Dispute resolution hearing due to her inability to negotiate at any level is set for the next few weeks.

Any advice?

Your partner's ex has no claim on your earnings or property.

You should tell his solicitor that you are pregnant, just in case. I don't think it is likely to affect the outcome, though. Once the baby is born, it will affect CSA payments if he has other children, as there is a reduction in payments to take account of children residing with him.
