What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hello Richard

Only my opinion but i think your wife has enough to deal with perhaps you should stop proceedings.

I don't know your situation but if her condition is terminal why are you even thinking about a settlement.
Illness is made worse by stress. Shouldn't her time left be peacefull and as happy as possible?

It's not me who's started proceedings.
I think she wants a divorce so she can leave a pile of money to
her daughter and grandson who'd get nothing if we are
still married when she dies.
Believe me - this is crucifying me to end things this way.

Hello Richard

Your wife can make a will and you can agrea it a sol will advise on how its done.

I dont belive the divorce process is the way to go it takes a long time and is very stressfull for all involved.

If your wife makes a will and you agrea a Consent Order its over sorted, then she will have peace of mind.

Your first post was regarding a change in your financial outcome

This is not true. She can make a Will and 'gift' monies (or property) to her daughter and grandson. She can also 'gift' a percentage to you. If she passes, and you're not yet divorced, you'd technically be her Widower, and you'd have the right to contest the Will if you weren't satisfied with her gift to you. However, that in itself will probably be another Court case....

In respect of her short time, ascertain what she wants, and try and reach a resolution if only to avoid the actual stress of Divorce proceedings.
