What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hello everyone

I have my Directions Hearing tomorrow as I try to overturn the Court Order inflicted back in June as my stbx has failed to comply with the majority of what was ruled.

Neither of us have legal representation so there will be no discussion before our half hour in front of the judge: will he actually decide anything or merely set another date for a full hearing?

it depends. is this a contact order? The Judge may well try to talk to both of you to see whether there is a way forward, and if there is a CAFCASS officer at court then it may be possible for you to discuss with him/her before going into court.

Thanks for the reply TBagpuss. No it was not a contact order (no children involved thank God).

Trying to enforce a sale of the FMH as stbx had not complied with the terms of the court order made by the judge over 3 months ago.

As it was the SAME JUDGE who made the ridiculous order in the first place preciding
over the Directions Hearing he decided to give her the benefit of the doubt.

Next step will be an out of time appeal in front of a circuit judge....
