Spent 4 hours and 45 minutes in Court and was awarded £300 per month from STBX until January (Final Hearing)!

Where do I start: Yesterday was absolutely shocking. STBX legal team presented a 10 page statement of issues(30 minutes before hearing). So my legals and I had little time to go through, but in doing so, it was filled with Absolute lies and inaccuracies about my financial circumstances:

EG: Stated I taken large amounts from savings from January to Oct (total lies bank statements show this)... Stated I was removing £600 in cash each month spending willy nilly. I dont even earn 600 per month, let alone lift it in cash, (my bank statements show this).

And much much more......it would take too long to list. But it was unbelievable, I mean really shocking, I am not exagerating. Obviously they couldnt find any inaccuracies in my finances as I am squeaky clean, so they decided to make it up. Nobody even bothered to look at the bank statements/evidence I provided!!

What is really frustrating that the STBX is the one spending all the funds and literally bought a property the day before the hearing to inflate his monthly outgoings. He has spent all of a 22 K savings account 10K in last 4 weeks. He spent copious amounts of money recently on holidays, clothes, weekend breaks etc

The final hearing was postponed in September past because ex job was supposed to be in jeapordy, but yet he can buy a property and get a mortgage the day before the hearing. I reckon by next hearing in January he will have bought a yaught and own an island somewhere.:ohmy:

All this BUT still stated on his documents that he was suffering financial hardship!!!!

The judge did not consider any of this spending and based his decision solely on fact I was working (finish contract Nov)and STBX now had a mortgage of £1,000 per month (taken on mortgage protection and life insurance also). The £300 awarded was to help maintain the matrimonial property which my STBX has a 50% interst until our Final Hearing in January. Did you ever....??

Should I be grateful for 300 per month (3 months), NO, to be honest if I''d got nothing it wouldnt have bothered me. What does bother me this ass of a LEGAL SYSTEM which I have absolutely no faith in. It seems the more truthful and honest you are the more you are tramped over.

PS My Barrister said he has never seen anything like it. Shocked that the judge passed no comment STBX pulling fast ones, buying a luxury 4 bed apartment day before hearing (they even provided photos of it??).

I am thinking is there any point in even turning up at next hearing cause they all make it up anyway!

Dear Redwine

Life can seem so unfair remember this is just an interim, I really hope it comes back on him in the end.

Stick with it, dont give up. I have dealt with an unscrupulous ex and it is hard and very exhausting so you really have all my sympathy.

Shocked to hear this, wha is the point of provinding financial information if the judge is going to disregard it.

I am just starting the process and although we only have the FH to fight over I wonder what the outcome will be if people can lie and get away with it.

I have read so many posts where this has happened so as you say what is the point of being honest.

How frustrating this system is!! Am spending hours on my form E in fear yet know my outcome will probably be similiar whilst he waltzes off with a smile....again.

My Ex have one house in London with joint name with his mother . and one property in Dubai (WHen He bought , I shared some portion of it ) .
I am living with my six year old son , Nothing left out .
I am doing job , doing financial order consent ,Does Court will consider theses two property in to account .and He have savings in India . I dont have any . How court will think about it .

Its not over until you walk out of the final hearing, all the judge has ordered is interim maintenance pending the final hearing outcome, you will have a new judge with fresh eyes, more importantly the judge dealing with with FH will have much more time to consider all the issues.
