What action is a District Judge likely to take if my stbx is found guilty of mis-disclosure?

It depends how serious the non-disclosure is considered.

Unfortunately there is no standard sanction and it will vary from judge to judge and court to court.

Some judges will draw their own inference such as (a) the non-disclosure is insignificant or (b) the non-disclosing party cannot be trusted and the other party''s position should be accepted in full.

However, nothing is certain.

Thank you for your reply.

My stbx has recently been working abroad and we have had our first sitting with the District Judge 3 weeks ago and my stbx has been told to produce anything outstanding (ie not already disclosed). It has recently been brought to my notice that the company he has been working for has paid him a sum in the form of wages. However, the company concerned has asked him for another colleagues address to send further monies he earned and the remainder to the woman he intends to marry after the divorce. Will my evidence to this effect be taken into account as it has been sent to me by a "friend" who works with the stbx and doesn''t want to be involved.

Is your friend willing to stand up in court and say this probably not, you may need to use tax payslips etc to prove he has a hole in his earning.
