Still waiting for the Court Order to be agreed between the barristers... Can anyone tell me what happens if the barristers can''t agree on the wording? It has been a few weeks already...

Hi there,

Barristers, like lawyers are instructed by the clients and the courts.

Assuming settlement has been agreed, either at FDR or Final Hearing the wording of the order still has to be agreed between the parties.

This can be straightforward but often needs fine tuning, orders are enforceable therefore it''s in your best interests that they are watertight and cannot be misinterpreted.

Frustrating, I know however long it takes your barrister is working to ensure the job is done properly.

I''ll wait to hear from my solicitor/barrister.

I am worried that it will last for months though as my STBX is trying to add unreasonable penalties.

I was so relieved after the FH, little did I know that the following weeks would be even more stressful...

How does this work? You had you FH and I assume judgement was passed? Does that mean that the barristers are now wording that judgement into an order?

Hello TurboB. Yes indeed I had the FH and judgement was passed - very quickly with some grey areas which my STBX is trying to manipulate to his advantage. My barrister volunteered to prepare the Court Order. It then goes to my STBX''s barrister for approval before we both sign it and the Judge puts her seal of approval.
I am not sure if the barristers have access to the recording of the judgement to double check some details. Would anyone know?
What if the barristers don''t agree on the wording, how much longer can it drag on? The whole divorce process has already lasted over two years. It feels like it will never end and I will spend the rest of my life trying to divorce my husband... :S
