Help... I am still waiting for the financial remedy to be finalised 2 months after the FH!
It seems that my STBX''s husband is coming up with new clauses. The worst part is that my solicitor does not seem interested in fighting my corner and just wants me to agree with it.
Knowing the importance of the order and how vindictive my STBX is, I want to make sure that the detail is right.
Can I ask for the transcript of the judgment only from the Court?
How long would it take and would there be a cost?

Transcripts are only available when a party intends to appeal an order - they are not made available as a matter of course - and when they are, there is a cost involved of around £500 per transcript.

If the parties cannot agree more costs will be incurred as you will need to go before the judge again.

This also means further delays and possibly a very cross judge if he/she feels either party is unnecessarily dragging things out.

If there''s not too much being argued about, you can submit the draft order to Court with both competing statements then let the judge decide on paper which one to include.

For example...

Dear Judge, here''s the approved Order, approved except one point at para 3 which we humbly ask your learned whatsits to consider.

Then in the actual order, perhaps mark in bold so it''s obvious:

3. The Court Orders that
[Wife] Husband shall pay for bananas
[Husband] Wife shall pay for apples

and that the fruit should be stored in the fruit bowl.

Or something like that...

I also disagree a tiny bit with guru RubyTuesday above... you have a right to a transcript unless a judge decides otherwise. They would normally approve an EX107 application. They are not cheap, think 150 - 600 pounds depending on length of hearing, but you can just request the bits you want, so for example you could just ask for the judgement, or just "wife''s evidence from 14:30 to 14:45" or whatever. You pay per word (roughly - there''s a nice archaic system of folio counts). If I had plenty of money I''d get all my transcripts, just for the happy memories!!!
