fair settlement? was created by dellou
I am self repping and would appreciate any advice on what i could offer as a fair settlement so that the courts are aware that I have attempted to negotiate a fair settlement!
both 51 years old
He runs two businesses but has not produced any books or income details, so for the sake of argument
His net income 20K
my net income 11k
cohabited 5 years married for 4
equity in property 50K ( I owned the property for 8 years prior to cohabitation) and have paid all costs before during and after marriage).
prospects of me obtaining a further mortgage are nil.
He lives in a council property although he states he is homeless for the last 9 years!!
I have a son in university who has learning difficulties so requires a home to come home to, I also have the responsibility of my father who has alzheimers and will be shortly moving in with me as he is a danger to himself.
ex has no pension as he has not paid NI contributions,
I have state pension plus £6k in additional
state pension
Marital debts of approx £10k which I have been paying since 2006.
I also have to pay a loan 0f 18k of which he guaranteed before going bankrupt- will this be taken into consideration?
Any body have a clue what I should be offering if anything at all!

How has he been homeless for the last 9 years? Is that how long you have been separated?

If not surely he lived in FMH?

Sorry he has stated he was homeless for 9 years Since 2006) but he had to leave the fmh for serious domestic violence against me (he served a prison sentence).

He states since leaving the fmh he has been homeless but I know he has a council flat but i dont know how to prove it! does being a council tenant satisfy his housing needs or does he need to be able to buy a property to satisfy his housing needs?

Are there Court Proceedings? I wouldn''t suggest you put forward an offer without full information/documents about his financial circumstances.

Just read your post again, What do you want to happen?

Do you work? How do you know he is living in council rented, yes this could satisfy his housing needs, would depend on the full circumstances of the case.
