after ex posponing first hearing since march over various excuses, finally going to the first hearing on tuesday,

we have exchanged form Es and his attitude in the form is that he thinks I should get nothing and that I should owe him money!

married 15 years house in his name a child of the family who he stopped coming to see last year also same time stopped the maintenance

he is now remarried pays her a wage and she works too, also listed his expenses as flights for her back to her country twice a year

I am dreading seeing him again and no he will not budge and the more this drags on the more stressed i get as can hardly keep up my rent payments let alone the mountain of bills i have now with working part time :)

Hi Bubblegum pretty nerve racking but glad its over :)basically alot of questions asked by judge as it is a complicated one, I applied for the proceedings as had stopped paying maintenance and cut off his 7 year old with no explanation, (who still asks why does daddy not come see me) there is also an intervener in the case as she co owns property but they been divorced 21 years!

so judge basically said \"21 years why are you even here as her solicitor turned up alone!

also as he was looking through the divorce papers i had attached an agreement which ex had signed to pay me x amount per month and an amount out of the property!!!

there faces did fall at that point so we have a list of directions and once a court order made there will be a 2nd fdr hearing he was asked to seriously go away and think about what he wants to offer,

also wants a house valuation
its not as bad as it seems hun and i am so glad now that I did it :)

Thanks for the update. Sounds like it went quite well. Did you self rep? Sounds like your STBX has a lot to think about, hopefully he will take notice of the judge and put forward a decent proposal at the FDR.

Is this an agreement you seek to rely on? Is your ex not wanting to keep to it?

Although agreements are not automatically binding, depending on the circumstances they can be either given no weight or substantial weight, or anything in between.

The words at the time were I will give you this and this and if you mention adultery or name the other woman in the application for divorce I will give you nothing

so was used as proof that he did agree i was entitled to something but we are looking at a larger share as was living in the fhm at the time

my ex thought he could get away with giving us nothing
