Did you draft the order yourself? Or use a solicitor or did the judge draft the order?

The EA my ex chose to use put the house on the market without even informing me told me he didn't need 2 signatures by law to list it.

I also wasn't in agreement with the overvalued listing price but couldn't do anything about it even though it was joint conduct for sale

all seems a joke!

Fingers crossed for you diamond74, court proceedings might still result in him buying you out if he turns up with a new mortgage offer. This will still be quicker than putting it on the open market. Good luck!

Mobbery, I didn’t do a draft at all, the Judge did it on the day, and we received a week or so later in the post. It will list all points that were ordered on the day. In my case the first one was 8 points long, the second order was only 2 points long.

Ultimately the house can’t be sold without your signature so whatever your ex or the EA does, it can’t be sold without your agreement. Even with sole conduct you still need both signatures.

my ex has been stalling and has also given me a figure to buy me out which is lower than what I should be getting. He thinks that I am desperate enough to accept this but I have children to house. I'm just wondering the outcome of court if ex turns up with mortgage offer that's lower wondering if the judge will expect me to accept..anyone have any knowledge of this happening?

He can’t change a consent order, you are entitled to what was agreed, he can’t change it as he feels like it.

Have you got a court date?
