What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

I'm trying to support and help my friend who has just received a copy of the Consent Order he finally agreed with his STBX and which was submitted to court end of June '21...the copy he received is from the court and is stamped with a court stamp....friend is LIP and between us we can't even tell if this is the 'sealed' order or not! there is a pension sharing annex also attached to the papers - nothing else. My friend was awarded cost of divorce going through court, ie £550. My first question is how do we know it is the sealed version? and how does friend get his £550 back....sorry but we're stumped...anybody help please? many thanks

It would appear that this is a stamped (approved) order. A copy of the pension sharing annex needs to go to the scheme trustees.

The order for costs from the divorce is separately enforceable. You can use the small claims procedure if a polite request for payment doesn't get anywhere.

thank you very much for your reply - often the obvious is not so obvious.....useful to know about the court costs as well. Much appreciated.
