What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Do you need help going to court over a Financial Settlement?

Hello Soulman

Glad to hear the nightmare that is called divorce is over for you. We have our first hearing on Monday and wondered if you could tell me a little bit more about the process? My partner's ex still hasn't submitted the 12 months bank statements, so we're going in a little bit blind. But any info you could give would definitely help with the sleepless nights!

Thanks very much.

PS. I promise to post all the details of our case when its all over and hopefully that'll help someone else. What a nightmare though!

Mamacita,

Unless you can come to an amicable agreement, which I take it you can't, otherwise you wouldn't be going to court, I would imagine if she still doesn't provide the bank statements at the 1st Appointment it will just be put to an FDR at a later date, with the judge giving orders for any outstanding documents to be filed by a certain date. This is what happened to me, as my x failed to provide relevant documents prior to 1st Appointment. There are many others on here who will tell you the exact same, the First Appointment is usually all a big anti-climax, sorry.

Regards, Sarah
