What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

We separated in September 2010 and my Decree Nisi was issued in December 2010. We sold FMH and bought our own properties, splitting equity 60% to me 40% my husband. Other financial issues were still being negotiated.

I decided to offer to reconcile, mainly because I gave in for an easy way out after suffering stress and being back on anti depressants. We have co-inhabited for 7 months and I now know it was a mistake and want to start proceedings again.

I''ve seen that you have to include declaration stating you have not lived together for 6 months or more when submitting Decree Absolute if there is a delay of over 12 months since date of Nisi. Will I be able to apply for the Absolute and explain that we have tried but failed a reconciliation, or will proceedings have to be started again (more expense)

Any advice very welcome.
Thanks
