What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

I''m in the middle of varying a Consent Order from several years ago and have to do it via courts as I live abroad. Had the first hearing and the date for the FDR has been set but I cannot attend on that date as I have to work on the day before the FDR and there is no one who can cover my role at the company so my employer would refuse to grant me holiday leave. Will this be a sufficient reason for the court to grand an adjournment?

I can offer them dates that I could attend but the one they have sent is impossible and I have to travel the day before the hearing so I have a chance to fly into the UK.

it depends how close the date is. It isn;t unreasnable to ask for it to be moved, but you need to do it on the earliest opportunity.

You can also make enquiries about whether it would be possible for you to atend by telephone rather than in person.

In the future, it is sensible to send a list of available / non available dates when asking for something to be listed as this is easier than trying to change it afterwards.
