I wonder if anyone can answer a question for me please, by the 29th which is in a few days I need to exchange with and file a Questionaire, statement of issues etc at court.

Now my Husbands Solicitor will not reply to me, so do I send her my statement etc anyway?

What happens if she does not send me his?

Or if I don''t get his shall I not send her mine?

I am confused

Its always best to do as court ask regardless of what the other side does.

If they are late make the judge aware, if they don`t do as court ask leave them to the judge to deal with.

I just feel that maybe they are waiting for mine to see what I have put with no intension of sending me his then that way they can have advanced notice of what the Judge will be requesting and plan ahead.

There is no advantage in who send them first, the fact is your right at the beginning and you will both have to exchange before anything meaningful can actually happen.

Don`t worry about it Paula this happens all the time and yes everyone worrys but you must do as the court order and leave those that don`t to the judge, many of which will not be bothered at all.

Once all disclosure is on the table then you can negotiate, if that fails its the FDR that really matters, this is the hearing where it tends to end with the help of a judge.

When you have never been in this position before it is very daunting.
