What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hi all,

I am Acting in person and need a barrister to represent me in the court. I checked with one of the barrister listed under direct access and her charge for 1 child contact hearing is £2000 + VAT (40%), now I am little bit concerned, its too much.

Can anyone advice me where I can find good barristers who take direct access cases but dont charge £2000 pounds?

Thanks

No I cannot but have you such a complicated situation that merits a direct access barrister?

I am assuming that you do not have a solicitor due to funds or another consideration; do you not realise that the courts are fully aware not only of the credit crunch ( hate that expression and the financial crisis - more relevent) but also of the emotional impact that divorce has on the family concerned.

Honestly, I dont know how to represent myself.
I can barely put my ponts across in a meeting let alone in front of judge, and knowing there is so much on plate, i wouldnt know where to start honestly.
I get tongue tied and if i am fighting for my child, then I need someone who has brains in child matters to speak for me.

Also, are direct access barrister expensive then usual barristers?

also, any input please where to get egood barrister but at more resonable rates?

It is hard I know. However, unless you have complex finances and a difficult case please believe me that your legal arguement in court does not merit expensive legal teams and neither do you have to be intimidated by the prospect of your stbx turning up in court armed up to the hilt with lawyers and barristers (hired guns).

Before you start to panic and think that the world is against you please post up the basics so that not only you but also us can take stock of your circumstance:

Ages of both parties
length of marriage
Children
Ages of Children
Assets held either jointly or together
Liabilites such as mortage or other
Debts in each name and length of those
Pensions
Any other assets or liabilities
Anything else that might be relevent

Your location is important for anyone to be able to recommend a barrister. Wikivorce doesn''t allow commercial links on the forum though so we will have to PM you with one if we''re able once you let us know where you are in the country.

I thought you said issues are for a contact hearing?

I have had a barrister at each hearing because my case is complex, my ex is difficult and a barrister charges a flat fee which is lower than a solicitor.

Barrister''s that I''ve had have charged £420 (inc. VAT) for Directions hearings.

One was £900 (inc VAT) for a half day contested hearing.

I''ve been quoted £1800 or £2400 from 2 different barristers for a 2 day final hearing.

Well I hope you have poven to yourself that your case is not complicated - I can see fronm what you have posted that it is not.

What is bugging you and I am not surprised that boiling behind the scenes are various what you see as traps and that your stbx is a little bit more than circumspect - by which I mean putting capital in his mothers names years before the split which to me shows that he was never that serious in his intentions to you (hard I know but I have no personal interest and am just looking at the disclosed circumstance and fact).

The fact that the car is in his mothers name is not relevent as who is the named driver and also who is the driver?
