I have my FDR hearing in just over 2 weeks times, i have read alot of posts on here that it seems to be the children that matter with the court.So far my children do not seem to have been mentioned they are aged 11 and 9 ,When do the children get mentioned and bought into the facts.Not even to sure whats going to happen at the FDR hearing.I'll put down some facts.

Married 11 years 2 children aged 9 and 11 younger child regiestered disabled.

Him self Employed has reduced he's weekly take home pay by over £700 in the last 2 months.

Me i'm my son's carer

His form E states he needs £3,368 p/m to live as a single person.Currently claiming to be earning £942 pm with CSA

I live in rented house rent £800 pcm help with most of the rent i still pay x amount myself him flat £320 pcm

CSA no payment since May 2006

FMH sold whilst still together £50,000 was to be used as a deposit on larger house, never happened he took 80 percent of the equity.Total equity £79,000

Property re mortgaged just before it was sold have found bank statements and requested a copy of the cheque, cheque made out to his name for £10,500

Timeshare in Florida not to sure of the value but maintenance has not been paid on property this yr , he always paid it.

No joint bank account or savings as he would'nt allow this

Him he bought a brand new sports car as soon as we split , where abouts of this car unknown at present as he has so far failed to answer the questions raised in court in Aug.


Him £44,000 cash spent in 8 months no proof what he has spent large payments on.

Guess i'm just trying to find some reassurance that it will be my children that matter.

But a court can only split what is there. I'm not sure why you sold the FMH, or why he took 80% !!!!!??? :ohmy:

Looking at the situation, it looks like YOU should've stayed in the home and got the 80%

I can't see how he can earn £700 per month, and declare he needs over £3k to live on! Who is he, David Beckham!!! ?

He'll need to budget more sensibly for his needs. He cannot live on thin-air or maintain a lifestyle he cannot afford.

My x2b claims living costs 0f 5k a month yet expects me and 2 kids 8 and 10 to live off the 1k he gives me..at the moment.. not had fdr til 5th dec. he is in FMH and im house sharing at a cost of £495 month.. im living off overdraft . My kids seem to have been forgotton as judge made no ref thus far to the financial req of them.. wait and see what he says he needs 5k for ( he earns it believe me) and ill have to fairly say that me and kids need 10k on those sort of figures!!! ha in a dream world. there is no fair play in this divorce and finances .. surely the laws needs to change!!!

Be reassured that your ex will need to list his 'needs', is there a form E disclosure yet? What does he claim his needs are?

CSA rule suggests 20% of his take-home pay for the two kids, so if he's not doing that, lodge your claim with them.

Your ex can claim all the stupidity he wants, but it's down to a judge to decide (if he can't) what is fair!

yes thats on his form E my sol has ? the living needs amoungst other stuff... answers whwere to be in for 26th oct and fdr on 5th dec. I have contacted csa but not heard back to date. I just have little faith at the moment as he holds all purse strings has family in hong kong and is an habitual liar .. his form e was hilarious and hopiing judge sees through him... could bloody scream at times ..could not we all

Let it out girlfriend!! :laugh:

It seems the more there is in the pot, the greater lengths they will go to - to hide it!

My soon2bx is currently trying to GIVE the house to his sister, erm, he contacted a lawyer on 1st August, we went to mediation in Sept and Oct, now he's cancelled that and trying to dispose of marital assets.

Ho-Hum, But yes, I think a judge will see through that!
