What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

I was threatened with x-petition/defence if I petitioned my x2b on UB rather than agree to him petitioning me on adultery that never happened, bullying I know but I did it anyway.

What I need to know is if he defends or x-petitions do you have to go to court for hearings? Is that always the case?

We were only married 10 months before we split up and he has 3 other marriages behind him (all never lasting over a year), he lives and works in Germany and mediation/hearings would be extremely hard to do and expensive for such a short marriage.

I don’t know what to do or think :(

After three marriages he should know the procedure by now.

I would hazard a guess that he is full of hot air and will not spend out thousands doing what he says.

Serve the petition on him and get the divorce asap would be your best bet.

Thanks SD, a lot of people are saying the same thing, I suppose the abuse doesn’t always stop after you separate and leave the marital home.

I just need to know what he will be told I guess

Your ex ought to be told to stop wasting his and your time and get on with his life and leave you alone.

Legally he can waste as much money as he wants on x petition/defence etc, the judge will just award a divorce on the basis that both you want it so the result will the same. get a NMO if he continues giving you hassle.

Hi CG....

If it's of any help to you...I have been told by my sol that I don't have to go to mediation with my S2BX... even though I am publicly funded... because, we both live farther that 45 miles from a mediation centre... so, I would imagine that if he's living and working in Germany, the same may apply to you...
This will be my S2BX's 3rd divorce... lol... maybe he yearns for greener grass constantly !!!!!
I could be wrong... but as I filed for divorce, and it was lodged in a court near to me, my S2BX is the one who has to travel to any hearings...
Check with your sol or with CAB...
Kind Regards
SL
