Where it's decided to make the first court hearing an FDR, is the judge responsible for checking all necessary information is in place - not allowing the FA to be made into an FDR if information is missing?
If, later, documents affecting the outcome are found to have been missing from FDR, who is responsible?
In my case it seems likely that Form P the pension inquiry form completed by the pension scheme before FDR was not submitted to court by my ex-husband's solicitor.
Is sanctioning making the FA into an FDR the responsibility of the solicitor or the judge?
Maggie. I dont know the rules but my 1st app was made into an FDR. The judge did nothing realy. We came to an agreement and he just checked it over. It was called a "Heads of agreement" it was hand written and the judge signed it. He didnt read it either. Nothing was checked as far as I saw. I was in the court room 5 mins tops. But I was all morning sitting in a room while my sol went back and forth. Thats what happned to me. Chris
