What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Dear Forum,

Just joined, having exhausted all available funds with solicitor to exchange of form E, and now I'm into the daunting task of self representation.

Thanks to an amazing input from ChrisM (Thanks again) who provided me with examples of Issues and Questions for preparation of my own due this coming Monday. My First Appointment is on Jan 15th.

Basically, my story is the stereotypical, with a gender reversal, account of a finally successful business person wanting someone younger (I'm 16 years older) after 16 years of loyal support and help with the business.

As I'm down to the bottom of an empty barrel of funding, my question is to do with an Order for Maintenance Pending Suit.

What and when is this requested?
Should I mention it in Issues for First Appointment, and/or bring a document to the Appointment.
I've seen some forum entries describing this document and I'm wondering if anyone has a copy, with appropriate items xxxxed out that I might look at or even a description in greater detail than I've been able to find.

Greatly appreciate any help,

Regards,

AScarp

List the lack of £ in the statement of issues

Prepare a list of income and a list of essential expenditure to outline the shortfall

Give 7 days notice to her solicitor of intention to apply for Interim Maintenance

It makes sense to deal at 1st appointment but you will have to lodge an application supported by a short sworn statement listing above

Dear attilladahun,

Thanks for reply.

Do you have any idea of what the application supported by a short sworn statement looks like. Is it a court form or a doc usually put together by a solicitor?

Regards,

AScarp
