What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hello

I'm new to all this, so apologies if this question has been asked before. Can anyone please define a short marriage for me, would it be counted from the wedding day to when the Decree Absolute is granted or would the marriage be considered over when one half leaves the marital home?
Thanks in advance

Great site by the way, very informative!

A marriage is considered

short - up to 5 years

Medium 6 to 11 years

Long 12 years plus

Living together prior to marriage can count

The marriage should count up to absolute as papers can be withdrawn prior to that

Depends on how long separated and how long to absolute...

Thanks for that.
Its a bit of a long story, but in a nutshell they (my other haf and his wife)split up in 1997 and we finally managed to get the divorce sorted out in 2007. We are due to go to court in a couple of months to sort out the house as the mortgage is in both their names.
