What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Good Day,

Not sure if this is the correct place to post this but if not I apologise.

My wife and I got married in South Africa but now reside in the UK. Do we apply for a divorce in the UK or do we have to go through the law courts of South Africa? If we do get a divorce in the UK and one of us moves back to South Africa but I keep the kids with me here in the UK - which courts have jurisdiction?

Thank you so much for any help or direction you can give.

Thank you so much for the quick responses folks. Neither one of us is on UK Passports. We have Indefinite Leave To Remain though. Have been here for about 18 months and both kids were born in South Africa too.
