What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

before i start i accept that the breakdown of my marriage is my fault.

i left my wife of 25 years in october to be with a new partner. my ex partner takes home £500 and i earn £3000. since the split i have paid all the bills and still have a joint bank account where my pay goes.

i have got to the point where i need to move on, i appreciate it from my ex's point of view, but i cannot carry on the way things are.

my ex has done very little to move towards a divorce but i cannot carry on making the payments i am currently doing for two homes - i will end up in severe financial difficulties if i do. what can i do?

Hi, you need to post a bit more information before being able to answer this question.

Are there any dependent children?
What is the house worth and how much equity?
Any other assets ie pensions, shares, savings etc?
Any other debt and whether joint or single?
Would your x be able to get more money from her job or benefits?

Just to clarify, in the eyes of the law it doesn't matter who is to blame for the break up of the marriage, this will not come into play unless there has been extreme behaviour. Finances are a totally seperate issue.

Regards, Sarah
