What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

I sent back my wifes divorce petition 2 months ago, the petition was for my unreasonable behaviour saying that I do not want to contest but do not agree to all the accusations . I have not yet heard anything from the court or her solicitor.

How long does it take to get a reply from the count? whats the next stage?

I do not have a solicitor to represent me. Is it a good idea to contact ex wifes solicitor and ask her whats happening?

If I remember rightly isn''t it 8 weeks & 1 day or something like that? I would give the court a ring & ask on Wednesday, they will be able to answer you fully.

I think really that it is a good idea to get the financial aspects & Consent Order sorted before the Absolute, so your x''s sols may not have sent it in yet? Have you sorted these out?

I ended up rining the court all the time, because of sols & x /x''s sols, they were really helpful, not in terms of advice but in terns of where things were.

Good luck JJx

Hi, we were only married for 6 months so there no financial claim involved. I received the petition and filled it in and sent it back to court. I understand the next step is the court will send the petition, which I have not defended, back to my ex who then has to apply for necree nisi..correct me if I''m missing something? So basically how long does it take for court to prOcess the nisi??

Many thanks
