What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

This is the situation.

Peter and Leanne have been married to each other for nearly 2 years. Months before they got married, Leanne cheated on Peter but he only found out after they were married. Peter decided to forgive Leanne and give their marriage another chance. He has a 9 year old son from a previous marriage and when his son''s mother died, Peter brought him up with Leanne. The little boy views Leanne as his mother now.

Several months later, Peter fell in love with someone else. Carla. They started an affair and when Leanne eventually found out, she told Peter that she would forgive him, like he had once forgiven her. Peter apologized but said that he loved Carla and that it was her he wanted to be with. So Peter then left Leanne to be with Carla.

There was a custody battle for the little boy, Simon. To cut a long story short, Leanne got back together with the man who she had cheated on Peter with, Nick.
Peter eventually allowed his son to live with Leanne and Nick. And Leanne was then granted a residence order. Simon had made it clear that it was Leanne he wanted to live with, not Peter and Carla.

Peter is a recovering alcoholic and so he wanted to get away to sort himself out, in the hope that he could return (after having some much needed time out) to be a better father to Simon. Peter and Carla left their home in Manchester, they have also left the country and have gone to the Caribbean.

My question is, how soon could Leanne and Peter''s divorce be finalized? Would it be possible for them to be officially divorced by December/January?

What do they definitely need to do?

Sounds like a lot of it has already been done if there has been a residence order granted?

Seems odd though that woman who has only known child for a couple of years and presumably doesn''t have PR is granted residency of child over natural father.
