What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hi Louise11,

This may be my first posting on the site but hopefully you will find the below helpful if you wish to look at case law. The site is quite comprehensive and covers family law as well as criminal law and covers Ireland, UK and International cases!

the site is

www.bailli.org/

If you put that in, you should come up on the bailli site which is the British and Irish Legal Information Institute. I use them frequently when researching case law for criminal caes and Rossi -v- Rossi is listed in the search. It brings up numerous ones just look for hte one with Fam in the titles, and bobs your uncle. Cant tell if this case has been superceded by anything else but happy hunting!

Hi Sally

Yes it did that for me, but i eventually got it. Its double ii at the end.

bailii.org. type it in your address bar it should get you there, my god though, happy reading!!! LOL

All this case law does my head in!

But when you get to a final hearing and an opposition barrister puts a file in front of a judge and says this is what we are basing our case on! You have to know what its all about. The trouble with i think they just try and baffle you with "science" dont think he read it properly either because when we did it blew his case right out the window! He had only picked the bit out that he wanted. Seems to me its thier interpretation of the case that they rely on. The summing up of that case shot his out of the water! Strange way to conduct yourself in my opinion! Also who on earth is going to read pages of case law, in two minutes and understand it, especially when you in a court hearing??? I was glad ours got adjourned so that we at least had a chance to read it.

Hope your ok and things are going well.

Kind regards
Louise
