What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hi all,

I'm thinking to start this process.

We divorced in 2015.

However I live in The MId East and my ex is in the UK.

How would I get representation If I am now no longer a UK resident since 2016?.

As its a non REMO country the CMS cannot have any say in maintenance too.

If we cannot come to an agreement, how would the court process work If I don't live there.

It's possible to have representation in this country.

The Court can still make an order but the range of orders will be limited or of little effect. However, even if part of the order is unenforceable, the agreement can be registered - through recitals or undertakings as necessary.

Thanks Charles.

What I meant was the Uk cannot enforce anything here and neither can they get proof of income .

Have you got UK assets?
If you don't engage with the financial settlement process including providing disclosure, inferences can be drawn and a settlement order may still be made.

You need to explain more about the financial circumstances.
