What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Just a quickie.............

If my solicitor sent my divorce petition to the Courts last Friday (9th)to be logged, how long will it be before x2b is served with the papers, and do they come direct from the court to her or back to my solicitors to then send to her solicitors.
Thanks in advance

Hi, once they are lodged at the court, they are then sent direct to the respondent from the court. This normally takes about 2 weeks. You will know the exact day when they are served as you will be sent a copy of your petition on the same day with a confirmation of your court reference no. for any future correspondence.

Good luck!

Madabout,

I filed my partner's divorce petition at Court on Wednesday 7th November and his stbx received the petition and acknowledgement papers on the Friday 9th November. It just depends on how busy the Court is, I think. In our case we were quite lucky as one of the Court clerks said they were up to date which is virtually unheard of for this time of year!

The Court will send a copy of the petition direct to the respondent I believe.

Regards

AG
