What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

My aunt has been married for 25yrs. Their marriage has not been good for several years. She has always paid the mortgage for their house. They have 3children. The 2 boys are at uni and the 14 yr old daughter is at home. They both want a divorce. He wants a bigger share of the house if it sells and all the proceeds of the endowement he has paid. Where does she stand legally? She sleeps on the floor in the daughters room for the last 4 years. Please advise
Thanks

It depends on who the daughter will be living with their respective incomes and pensions etc. No-one here can give you advice without that sort of information, I'm afraid. She should also take legal advice - most solicitors do a fixed fee initial consultation, some do this free.
