What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

My girlfriend is currently going through a divorce. It is uncontested as is the financial settlement.

She has just been told by her solicitor that the financial settlement can only be applied for (or completed?) after the Decree Absolute and may take around 6 weeks from the decree absolute. I find this extremely hard to believe because although I know that these are two separate things I would have assumed that they ran simultaneously.

Can anyone tell me if this is right or if there are ways to speed this up- the issue here is to get her house transferred from joint names into hers as soon as possible.

I'm in a similar situation - ie awaiting the financial settlement to find out if I can afford to stay in the flat. Our Decree Nisi came through this morning, and my sol said that I should not apply for the Decree Absolute until AFTER the financial settlement had been agreed. That makes sense to me.
Best wishes.
