What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hi All,

My x2b made an application for ancillary relief on 3rd December 2007 and I need to fill form E by 25th Feb 2008. I need to disclose my last 12 months bank statements with Form E, now the quesion is these 12 months bank statements will start from the date when ancillary application was made (i.e. 1st december 2006 till 31st dec 2007) or will be from the date of filling form E (i.e. 1feb 2007 till 1st feb 2008)?

Please advice.

Nonmol,
I believe it's the 12 months prior to the date of the Form E, ie 1st feb 07 to 31st Jan 08 will be OK.

One can ask for more bank statements if there is a particular reason, eg spouse says a sum of money was spent on necessities but you have reason to believe it has been hidden away in an undeclared account or given to a family member for 'safekeeping'.

if my xtb says it is been given to my family member for sefekeeping, what can I do to say it was loan repayment or something like that to save it?

Hi

Its 12 months from the date of filing form E.
You will need proof of any loan repayments, i.e. a letter from whoever it is you are claiming to owe the money to.
Be very careful though as the other party can call them to take the stand and declare that on oath at a FH.
Which is what I would do if I knew my ex to be had salted money away that rightfully belonged to us both and was earned during our marriage!

Kind regards
