What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

How can I begin to Petition for divorce if I don''t have a new address for my husband? He tells me he is in a hotel, but I don''t know if thats true. Can I use his parents address?

He needs the papers to go to where he officially lives, they can''t be sent to a parents because you can''t prove he got them, if you think he is going to be difficult you may need to have him served, or get some proof he actually received the Petition just won''t return it.

Use the wiki search bar and read about depending or deeming service.

I don''t think he will necessarily be difficult. I just want to move on now and he hasn''t sorted out a permanent place of residence yet. I don''t know when he will.

If your husband agrees you could both ask court if his parents address could be used in these circumstances, he must agree though to stand a chance.
