What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Firstly I hope this is the right place to ask this and sorry if it isn''t.

I have filed for divorce after 2 years separation, it is an uncontested divorce and I have now received the paperwork back from the court confirming that my ex will not be contesting the case.

When I filed for devoice and answered the question in part 6 Statement of case I put the following:

Marriage Irretrievably broke down and by mutual consent we decided that we could not longer live together so we separated and I moved out on the 16th May 2008

The Respondent Consents to the decree being granted

No I am applying for he decre Nisi and have an Affidavit in support of divorce that I am filling in and before I complete it I wanted to ask. Do you think I Have put enough information to support my case for a Decree Nisi?

Many thanks in advance

Paul

Yes, no problem. As long as your ex gave her consent to the divorce it should go through smoothly.

Hello Paul

It looks ok, most solicitors would add "since the date of separation the applicant and respondent have not lived together" it just saves a judge questioning it.
