What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Divorce proceedings started by wife. Advice please

Received a letter from wife''s solicitor stating that she has instigated divorce proceedings, that she has been given a form E and that I am to expect to receive the Petition in due course.

General position is that she left the marital home 12 months ago leaving me with sole care of two teenage children, one of whom has left home now and is living independently, one remains with me.

The marital home is mortgaged and mine is the sole name on the deeds.

I have no income to speak of, I''m on income support and receive carers allowance for my non-resident new partner.

Just looking for some knowledgeable advice about the best way forward from here please.

If you can search under '' Spotlights '' in the forum topic '' Property and Mortgages '' you will find something called Housing Options after separation.

May I suggest you might perhaps dig this out and read it. One of the reasons I wrote it is to be able to give some general guidance.
