Hi Wiki''s, I am hoping that someone can give my boyfriend some advice? His wife left him nearly 5 years ago to move in with her boyfreind and petitioned for divorce 2009, 1st hearing listed for the 28th May but the form "E" has not been exchanged! The court has now sent a penal notice to his Wife to exchange the form "E".
She has basicly been dragging this out for ages. She has her own property but is now in the process of being reposessed, she is also not working, all children from the marriage are grown up and only the Son who is 26 is living with his Father. She has asked my Boyfriend if it would be possible for her to move in with him with their youngest Daughter who is twenty and who is also not working until she can sort something out. It seems that she would like to move back in and expect him to support her, what can he do? It is her fault that she lost her property as she is a spendthrift and she also has lots of debt, my Boyfreind has only just managed to get his finances sorted out as she also left him with a loan of £10k. He is really stressed and so am I. please help?:(

He can (and should) tell her to take a long walk off a short pier. She created her own problems and must now face the consequences of her actions.

Although you are supposed to swap form E''s before 1st appointment, not many do. I dont think form E''s are needed until FDR or at least FH. Thats where they usualy come in.

I think yr BF could offer to home the daughter but why should he home the ex? Its upto him. But I wouldnt. C.

He simply needs to say no to her. After 5 years separation, there''s no way a court would expect him to allow her to rejoin him. If she fails to comply with the order for her to file a form E, I guess her housing needs will be met, courtesy of the taxpayer and HMP Wherever!

She has also said that she will not be going ahead with the divorce due to financial reasons, can he apply for a 5 year seperation, or apply to be the Petitioner as she is dragging her heels? and if yes does he have to get her to withdraw her petition?

Since he is already in the process of Ancillary Relief I assume Decree Nisi has already been granted?
