What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Will try negotiating but I reply within a couple of days and her sol'' replies within a couple of months!

That''s solicitors for you :)

If the time drags on too much then you could apply to court. It''s not reasonable to be kept waiting, and you have a right to get a resolution to the finances of your marriage in a reasonable timescale. If they are not co-operating in a timely manner then a court application can help grease the wheels.

Also have to find £50k to give her now, no idea why they''d suggest this when they have clearly seen my assets and know I have no such funds!

Have to?? You mean, they want you to? Just because they say, does not make it so.

If you''re happy and agree with the £50k lump sum then I would suggest negotiating on the nominal SM, saying something similar to, "I am not happy to agree to a nominal spousal maintenance order since I believe any potential future spousal maintenance has been capitalized in the lump sum payment of £50k".

Yeah, thanks for putting a different angle on it for me Cookie. It is their first proposal and if I could do it I would - apart from the nominal maintenance thing.

I am self repping so have no idea of what is fair but after a year of ping-pong I just want it over and done with so I can get on with my life.

Thanks everyone, for all you help, this site has been and continues to be, an enormous support.
